Drone rules in the USA: what a beginner actually has to do in 2026
The 249 gram line, TRUST, Remote ID and where you can legally fly — the short version, without the acronym soup.

Start with weight, because weight decides everything
Almost every question a new pilot asks — do I register, do I need Remote ID, can I fly in the park — traces back to one number: the take-off weight of the aircraft. In the United States the dividing line for recreational flyers sits at 250 grams. Below it, the paperwork burden for recreational flying largely disappears. At or above it, you register with the FAA, you pay a small fee, you mark the registration number on the airframe, and you fly with Remote ID.
This is why so many consumer drones are advertised at 'under 249 g'. It is not a coincidence and it is not marketing fluff; manufacturers deliberately engineer to stay under the threshold because it removes a barrier to purchase. A 85-gram foldable and a 135-gram selfie drone are both comfortably clear of the line. A 249-gram mini is deliberately hugging it.
One trap: weight means take-off weight, not box weight. If you bolt on a bigger battery, a camera filter set or a payload clip, you can push a compliant drone over the line without noticing. Weigh the aircraft as you actually fly it.
TRUST: the free test nobody warns you about
Recreational flyers in the US are required to pass The Recreational UAS Safety Test, universally shortened to TRUST. It is free, it is online, it takes most people twenty minutes, and you cannot fail it permanently — if you answer wrong, it teaches you the right answer and moves on. At the end you download a completion certificate.
Two practical notes. First, the certificate is not reissued by the FAA, so save the PDF somewhere you will still have it in three years — email it to yourself. Second, TRUST applies regardless of drone weight. The 249-gram exemption covers registration, not the safety test. A pilot flying an 85-gram toy in a public park is expected to have taken it.
Registration and Remote ID, in one paragraph each
Registration is done through the FAA DroneZone website. For recreational flyers it is a single registration number that covers all the drones you own, valid for three years, for a nominal fee. You write or label the number on the outside of the aircraft where an inspector could read it without opening anything.
Remote ID is a broadcast requirement: an affected drone transmits its identity and position so it can be identified from the ground. Modern drones above the weight threshold ship with it built in. Older airframes can be brought into compliance with a broadcast module. Recreational drones under 250 grams are outside this requirement — which, again, is why the sub-249-gram class dominates the shelves.
Where you can fly, and the app that answers it
The rules that get people in genuine trouble are airspace rules, not paperwork. Controlled airspace around airports requires authorisation, granted in seconds through LAANC-enabled apps for approved areas and altitudes. National parks prohibit launching and landing. Many stadiums, military installations and critical infrastructure sites have standing restrictions, some of them temporary and event-driven.
Download the FAA B4UFLY app, or a LAANC provider app, and check before every flight in an unfamiliar place. It takes fifteen seconds and it is the single highest-value habit a new pilot can build. 'I didn't know it was controlled airspace' is not a defence, and the airspace map around a mid-sized city is far busier than most people assume.
Beyond the map: keep the drone within visual line of sight, stay at or below 400 feet, do not fly over crowds, do not fly from a moving vehicle in a populated area, yield to manned aircraft always, and do not fly at night unless your aircraft has the required lighting and you know what you're doing.
Privacy, which is law-adjacent but socially decisive
Federal airspace rules say almost nothing about photographing your neighbours; state harassment and privacy statutes say plenty, and vary widely. The practical rule that keeps you out of arguments is simple: do not hover over private property that isn't yours, do not film into windows, and if someone asks what you're doing, land and answer them like a person. Most drone complaints are social, not legal, and they escalate because the pilot got defensive.
A pre-flight checklist you can actually remember
Props on tight and unchipped. Battery above 50% for a short flight, full for anything longer. Home point set where you are actually standing. Airspace checked in the app. Wind checked — if the trees are moving hard, a sub-100-gram drone will struggle. Line of sight planned, so you're not flying behind a building. Return-to-home altitude set above the tallest obstacle nearby.
That list takes under a minute and prevents the overwhelming majority of lost drones. The most common cause of a crash is not equipment failure; it is a pilot who launched without thinking about wind, obstacles or battery margin.
The commercial line
The instant your flight has a business purpose — even indirectly, even unpaid content promoting your own business — you're outside the recreational exception and into Part 107 territory, which means a real knowledge exam and a certificate. If you're posting drone footage to a monetised channel or shooting a friend's property listing 'as a favour', assume Part 107 applies and go and get it. The test is passable with a couple of weekends of study.
